In short, if a person is declared dead and no will exists, the law of intestacy prevents the person's assets from being distributed as the deceased would have wanted. The surviving spouse or children are not entitled to the decedent's assets, and instead, those assets are given to the closest blood relatives. If there is no will, then these heirs become the successors-at-law of the deceased.
