It's a legal proceeding and a state law, so it isn't uniform across the country or even between states that have similar laws. Because of the way it's set up in most states, probate can be expensive and time-consuming, so you might want to avoid it if possible. What is probate? Probate is the legal procedure that distributes a person's property after they die. The probate process begins when someone files a petition to open an estate, which includes information about the deceased. Control over the assets That filing then gives control over the assets (money, property, etc.) of the deceased to the executor of their estate.
