Usually, they will serve you with a statutory demand first. They will then file for bankruptcy if the debt is not paid. Involuntary cases In many cases, a creditor can file bankruptcy on behalf of a debtor. The creditor will have to provide all necessary information to the trustee in the bankruptcy case. If the creditor fails to provide the necessary information, they will be removed from the case. The bankruptcy trustee will also make a meeting of the creditors to discuss your bankruptcy case. It is important to attend this meeting and answer any questions that the creditors may have. If you do not attend the meeting, the trustee may begin selling your assets.
