Why would a judge not grant 50/50 custody?

When considering a divorce, the best possible outcome is often 50/50 custody, where each parent is granted equal time with their children. But sometimes judges will not grant this arrangement—or they might try to split time unequally—and it's helpful to know why.

In most cases, judges are more likely to favor one parent over another when one of them has a history of substance abuse and/or domestic violence, but it often comes down to which parent the court believes is more likely to take advantage of the other parent's absence. A judge may also believe that one parent's living situation would be more harmful for their children (for example, if one parent has a new partner who is abusive), or that one parent would be better able to provide for their children financially. There are many factors that can influence a judge's decision about how much time the kids will spend with each parent, but all of them have the same ultimate goal: to ensure that the kids' best interests are foremost in anyone's mind.
