Can my ex get full custody if he doesn’t have a job?
If you're asking if your ex can get full custody of the kids if he doesn't have a job, the answer is… probably not.
There's a whole bunch of reasons why this is unlikely to happen—not least of which is that you'd be required to prove that your ex was unfit to be a parent in order to establish that he did not meet the needs of his children. But even if you could make that case, it wouldn't necessarily mean he would lose custody.
You see, judges will look at several factors when deciding on custody cases: how much time does each parent spend with their children? What kind of relationship do they have with their children? Does one parent have more experience raising children than the other? And so on.
So if your ex has always been a great dad and has always shown an interest in being involved in his kids' lives and helping them develop into happy adults, then chances are good that he'll still get custody unless there's something really egregious about his behavior, or lack thereof.
Let's talk about how you got custody in the first place: Your ex-husband is probably going to try to argue that he needs more time with their child because he doesn't have a job. But here's what we know: if your ex-husband doesn't have a job and is getting child support, then he can't be seen as a good parent.
Even if he was able to pay for everything for you and the child, it would still be better for your child if you had full custody because it would help them to feel safe and loved.
So what does this mean? It means that even though your ex-husband might still have some visitation rights after losing custody of his daughter, things will probably be very difficult for him if there are any issues that arise in regards to parenting or discipline.
It also means that if something happens between you two where one of you feels like the other is being unfair or not doing enough for their child, those feelings could spill over into the relationship between him and his daughter and cause problems down the line
